Waiver of Liability and Media Consent & Release

IMPORTANT NOTICE

Your presence at or participation in any event organized by Stunt Showdown LLC signifies your acknowledgment and acceptance of the terms outlined in this Waiver of Liability and Media Consent & Release. By attending, spectating, or engaging in any activities associated with the event, you are deemed to have granted your irrevocable consent to these terms without further signature, acknowledgment, or action on your part.

If you do not agree to the terms described herein, you must not attend or participate in any capacity.

Acknowledgment of Risk

By entering the venue or participating in any activity or event organized by Stunt Showdown LLC, you acknowledge and understand that there are inherent risks involved. These risks may include, but are not limited to, the following:

  1. Physical Injuries: Risks associated with participation in physical activities, including stunting, tumbling, or cheerleading, may result in:

    • Strains, sprains, or pulled muscles.
    • Bone fractures or joint dislocations.
    • Cuts, bruises, or abrasions.
    • Head injuries such as concussions.
    • Catastrophic injuries resulting in permanent disability or death.

  2. Environmental Risks: These may include adverse weather conditions, uneven terrain, or other unexpected hazards at the event location.

  3. Third-Party Risks: Injuries or damages caused by the actions or negligence of other participants, spectators, or staff.

  4. Facility and Equipment Risks: Risks arising from the use of equipment, props, or other items provided at the event, which may include malfunctions, breakages, or improper usage.

  5. Unforeseen Risks: This includes risks that cannot be anticipated, such as sudden crowd movements, emergencies, or unforeseen incidents during the event.

You acknowledge that participation in these activities is entirely voluntary, and you assume full responsibility for your safety and well-being during your attendance.

Waiver of Liability

In consideration of your participation in or presence at an event hosted by Stunt Showdown LLC, you agree to the following terms:

  1. Release of Liability: You hereby waive, release, and forever discharge Stunt Showdown LLC, its owners, directors, officers, employees, contractors, volunteers, sponsors, affiliates, agents, and all other representatives (collectively referred to as "Releasees") from any and all claims, demands, liabilities, or causes of action that may arise in connection with your participation in the event.

  2. Scope of the Waiver: This waiver applies to all claims, including but not limited to:

    • Claims for negligence or failure to act.
    • Claims related to injury, illness, property damage, or death.
    • Claims for emotional distress or psychological harm.
    • Claims related to unforeseen events or emergencies.

  3. Broad Applicability: This waiver is intended to be as broad and inclusive as permitted by applicable law. If any provision is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

  4. Voluntary Participation: By attending or participating in the event, you affirm that you are doing so of your own free will, with a full understanding of the risks involved.

Medical Consent and Emergency Authorization

In the event of a medical emergency during the event, you grant Stunt Showdown LLC and its authorized representatives permission to seek and obtain medical treatment on your behalf. This includes, but is not limited to:

  • Administering first aid.
  • Arranging transportation to a medical facility.
  • Authorizing the provision of treatment by licensed healthcare professionals.

You acknowledge that all medical expenses incurred as a result of such treatment are your sole responsibility, and you agree to hold Stunt Showdown LLC harmless for any outcomes related to medical care.

If you have any known medical conditions, allergies, or other health concerns that may impact your participation, it is your responsibility to disclose this information to event organizers in advance.

Media Consent & Release

Scope of Consent

By attending, participating in, or being present at any event organized by Stunt Showdown LLC, you irrevocably grant the following rights to Stunt Showdown LLC and its affiliates, agents, contractors, and representatives:

  1. Capture of Media: The right to photograph, video record, live-stream, or otherwise capture your likeness, voice, and performance during the event.
  2. Modification Rights: The right to edit, enhance, alter, or otherwise modify such media for any lawful purpose.
  3. Distribution and Use: The right to publish, display, and distribute the media in any format or platform, including but not limited to:
    • Social media (e.g., YouTube, Instagram, Facebook, TikTok).
    • Promotional materials such as brochures, posters, and advertisements.
    • Press releases, websites, and other digital or print publications.

Retention and Perpetuity

Media captured during the event may be retained indefinitely by Stunt Showdown LLC for use in current or future projects. You acknowledge that such media may remain publicly accessible in perpetuity on platforms such as YouTube or other online repositories.

Waiver of Inspection Rights

You waive any right to inspect or approve the media or its use, including any captions, titles, or text associated with it.

No Compensation

You understand and agree that you will not receive monetary or other compensation for the use of your likeness in any media produced by Stunt Showdown LLC.

Release of Claims

You release and discharge Stunt Showdown LLC from any and all claims, liabilities, or damages arising from the capture or use of media, including but not limited to:

  • Claims of defamation or slander.
  • Claims for invasion of privacy or violation of publicity rights.
  • Claims for emotional distress or reputational harm.

General Terms and Conditions

  1. Binding Agreement: By attending or participating in the event, you acknowledge that you have read, understood, and accepted the terms of this Waiver of Liability and Media Consent & Release. This agreement is binding upon you, your heirs, and your legal representatives.

  2. Minors: If you are the parent or legal guardian of a minor attending the event, you agree to these terms on behalf of the minor and assume all associated risks and liabilities.

  3. Jurisdiction: This agreement shall be governed by and construed in accordance with the laws of the Commonwealth of Pennsylvania. Any disputes arising from this agreement shall be resolved in the courts located within Pennsylvania.

  4. Entire Agreement: This Waiver of Liability and Media Consent & Release constitutes the entire agreement between you and Stunt Showdown LLC regarding media use and liability and supersedes any prior agreements or understandings.

Final Notice

By entering the premises or participating in activities associated with Stunt Showdown LLC, you fully accept and agree to the terms and conditions outlined above. Your attendance serves as your acknowledgment of and consent to this agreement in its entirety.
